
2011 Bone Rock Girl - Official Rules
A complete copy of these contest rules can be obtained at the offices of radio station KSAN-FM/107.7 The Bone (the "Station") owned and operated by Susquehanna Radio Corp., a wholly owned subsidiary of Cumulus Media Partners LLC, 55 Hawthorne Street, Suite 1000, San Francisco, CA 94105, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.
The Station will conduct "The Bone Rock Girl Competition" (the "Competition") substantially as described in these rules, and by participating, each participant agrees as follows:
1. No purchase is necessary. Void where prohibited. All federal, state, and local regulations apply.
2. Unless otherwise specified, only legal U.S. residents, who reside in the nine Bay Area counties (San Francisco, Marin, Contra Costa, Solano, Alameda, Napa, Santa Clara, San Mateo and Sonoma), who are female, 21 years of age or older, with a valid Social Security number at the time of entry, are eligible to participate in this station competition.
Any person who, as of January 1, 2011, has any type of talent and/or management representation (e.g., a talent agent or manager), is under any type of professional performance contract (including but not limited to, a music recording contract, a talent contract, an acting contract), and/or is party to a merchandising or sponsorship contract is eligible to participate in the competition but the participant will be responsible for any fees to these agencies.
Any person who is a member of AFTRA or any similar union is NOT ELIGIBLE to participate in the competition.
Participants may be required to complete a written application and provide proof of age and U.S residency.
KSAN-FM/107.7 The Bone reserves the right to disqualify any participant at any time in its sole discretion. Participants who provide any false information with respect to employment history, background or other credentials, may be immediately disqualified or, if already hired, immediately terminated.
3. Unless otherwise specified, employees, agents and affiliates of the "Station," Susquehanna Radio Corp., Cumulus Media Partners LLC, Cumulus Media Inc., Cumulus Broadcasting LLC, competition sponsors, other radio, television and print advertising companies serving the Station’s metro area, and their immediate family members and household members are not eligible to participate or win station contests or competitions. The term "immediate family members" includes spouses, parents, siblings, grandparents, children, grandchildren and co-habiting significant others. Other restrictions apply.
4. The competition will begin Monday, March 7, 2011 and will run through Wednesday, May 5, 2011 (the "Competition Period").
5. The Station will conduct a search to find one person to be the 2011 Bone Rock Girl and represent the Station at promotions, events and on-air from May 2011 to May 2012.
6. CASTING CALL
Those who wish to participate in the search will be asked to send in, via email, at least two (2) photos of themselves along with personal information (name, address, birthdate, phone numbers, etc.). Participants may also include a short video presentation if they wish. Representatives of the Station may contact participants by phone to get further information and to judge personality and speaking ability.
Deadline to enter the casting call is 11:59pm (Pacific), Thursday, March 31, 2011. The casting call may continue past the posted time deadline at the discretion of the Station.
By participating in this search, each participant hereby consents to the Station’s use of her name; voice; likeness; and biographical information for on-air broadcast and for advertising and promotional purposes without payment or additional consideration. All participants further agree that the Station owns or will own exclusively any recordings, video, or photographs of such participants, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all participants assign all such ownership rights to the Station.
Station shall have the right to copy, edit, broadcast, publish and use, in whole or in part, any materials featuring participants, in any manner without compensation.
Participants agree to submit to a criminal background check.
Participants must not have any conflicting obligations, contractual or otherwise, that would interfere with their obligations if chosen to be the 2011 Bone Rock Girl. In the event a participant has such conflicting obligations, the Station may disqualify that participant from serving as the 2011 Bone Rock Girl and/or select another participant to serve as the 2011 Bone Rock Girl, in its sole and absolute discretion.
7. JUDGING
Participants will be judged based on their presentation, personality, speaking ability and self promotion. Judging of participants will be by representatives of the Station. Alternates may be chosen in case any of the original participants are not able to continue in the competition. Participants will be graded as follows:
I. 30% Personality
II. 40% Presentation
III. 20% Speaking ability
IV. 10% Self promotion
The decisions of the judges are final.
8. ON-AIR AND ON-LINE JUDGING
At the conclusion of the casting call period, station judges will select participants to have their photos, biographical information and/or videos posted on-line on 1077thebone.com the week of April 4, 2011. Upon being chosen, participants may be required to complete a written application and provide proof of age and U.S. residency.
On Monday, April 11, 2011, sixteen participants (the "Sweet 16") as chosen by station judges will be featured on-line and listeners will be asked to vote for their favorite 2011 Bone Rock Girl. Voting will conclude on Sunday, April 24, 2011 at 11:59pm (Pacific). Only one entry per person per day will be allowed. Listeners are encouraged to vote for their favorite, the outcome of which will be a factor (but not the sole factor) in the Station’s determination of the winner.
On Monday, April 25, 2011, the "Final 4" participants will be announced on 107.7 The Bone and posted on-line. 107.7 The Bone will invite the "Final 4" participants on-air and throughout the week, listeners will be able to vote on who should be the 2011 Bone Rock Girl. Voting will conclude on Wednesday, May 4, 2011 at 11:59pm (Pacific). Only one entry per person per day will be allowed. Listeners are encouraged to vote for their favorite, the outcome of which will be a factor (but not the sole factor) in the Station’s determination of the winner.
Listeners who do not have on-line access may also register their Bone Rock Girl vote by calling 415.995.6878 and leaving a detailed message. Listeners may only vote in this fashion once per day.
On Thursday, May 5, 2011 (or another date to be determined), the "Final 4" will be required to attend a station event for the selection and Coronation of the 2011 Bone Rock Girl. Location and time of event to be determined. The decision on who will be crowned the 2011 Bone Rock Girl will be made solely by station management and the decision will be final.
In the event of a tie during any round, station management will decide who will move on in the search. If the winner of any tie-breaker cannot be reached by phone within two (2) business days, then that person will be disqualified and the participant with the next highest score will be chosen in her stead.
Should a participant fail to comply with any of the official rules or fail to appear for the competition on such date(s) and time(s) as established by the Station, then such participant shall be disqualified at the sole discretion of the Station. If it is determined that the candidate is not eligible to win, it is the Station’s sole judgment and discretion that another candidate will be selected for eligibility consultation and the process will continue on until such time as an eligible candidate is found.
The Station cannot be held responsible for server errors or other online access problems regarding the voting periods. The Station reserves the right to extend the on-line voting period(s) if technical difficulties should arise. KSAN-FM will use commercially reasonable efforts to ensure that the on-line and phone voting is fair to each participant and will keep the integrity of the system as balanced as possible. Winners must provide satisfactory references and proof of identification and work authorization as required by the Immigration Reform and Control Act of 1986.
9. AWARDING OF THE TITLE
One participant will be selected as the 2011 Bone Rock Girl. The selected participant will receive $5000.00 and agrees to act as an independent contractor of the Station; she will not become an employee of the Station. Total Grand Prize package is valued at $5,000, plus any compensation from appearances throughout her term.
The 2011 Bone Rock Girl agrees to enter into a contract with the Station, which will outline the obligations owed to the Station by virtue of being the 2011 Bone Rock Girl. The Station shall have the absolute right, without incurring any liability to the selected participant, to terminate the contract if the selected participant does not cooperate with the Station in making the requested appearances or otherwise violates the spirit of the contract. If the Station terminates the contract because the selected participant fails to cooperate in making promotional appearances, the selected participant will have no right to receive any money after the date the contract is terminated and the Station will have no obligation to pay any money to the winner after that date.
The 2011 Bone Rock Girl must be available to participate in station activities as required and assigned by programming and promotions, and be willing to travel around the San Francisco area and to other destinations. The 2011 Bone Rock Girl must be available to participate in Station activities during non-traditional hours including nights and weekends. The 2011 Bone Rock Girl must be willing to appear at different venues and types of promotions including but not limited to concerts, bars, nightclubs, retail locations and more. The 2011 Bone Rock Girl must be willing to dress in appropriate apparel for station events.
The 2011 Bone Rock Girl will not be guaranteed a minimum number of appearances or hours during her tenure as the Bone Rock Girl. The Bone Rock Girl appearances will be booked throughout the year as the promotional calendar allows.
Each participant will be required to sign a Release relieving KSAN-FM/107.7 The Bone, Cumulus Media Partners LLC, their affiliated entities and each of their respective agencies, representatives and assigns and each of their officers, directors, employees, agents and sponsors from any and all liability with respect to her participation in the search, and the receipt and/or use of the prize, and/or her activities as the 2011 Bone Rock Girl. Any person who refuses to sign the Release and/or provide a valid Social Security number will be disqualified.
OTHER
All Station events, including on-air appearances by the participants, may be recorded by the Station and shall be the sole and exclusive property of the Station and may be broadcast on-air and used for promotional and advertising purposes without permission or compensation.
Station reserves the right to change, alter or modify these rules, dates, times, and/or locations at any time with or without written notice. Material changes to the rules will be broadcast on-air, when practical.
Station reserves the right to end or stop any competition at any time and for any reason.
Station management shall decide all matters relating to the competition and the interpretation of rules. The decisions of Station management shall be final. Entry in the competition constitutes agreement by all participants to abide by these rules, as well as any other rules established by Station.
10. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for winning the competition become the sole responsibility of the winner. These include any compensated appearances during the 2011 Bone Rock Girl’s term. An IRS Form 1099 will be issued to report these earnings.
11. All prizes are awarded "as is." Prizes are non-transferable and cannot be exchanged, sold or redeemed for cash or other prizes. No substitute prize will be awarded to a winner who declines to accept the prize.
12. Unless otherwise stated, the odds of winning a station competition depend on a number of factors, including but not limited to, the number of eligible entries received and the number of participants at any given time.
13. The Station shall not be responsible for a failure of participating sponsors to deliver the prizes or any part thereof.
14. All entrants agree that the Station shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing this competition and/or by the use or non-use of any prize received in connection with this competition.
15. All prizes must be claimed in person at the station at the address identified above during regular business hours and within 10 business days of notification.
16. Proper identification must be presented by any winner to claim prize.
17. All entry blank forms, devices and materials gathered during the course of entry, as well as information contained on or within, shall become the sole property of the station to be used, disposed of or destroyed in its sole discretion.
18. The Station is not responsible for any incorrect or inaccurate information submitted by the competition's participants or entered by website users and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications, line failure, theft or destruction or unauthorized access to the Station's website.
19. All entrants and winners agree to give the station and its licensees, affiliates, successors and assigns the irrevocable and unrestricted right to use, reuse, broadcast or publish their name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part as part of a composite, retouched or distorted in character or form, and voice, recorded or live, for any reason the Station deems necessary without compensation, unless prohibited by law.
All entrants and winners release, discharge and agree to hold the station harmless from any and all claims they may have against the station in connection with the foregoing.
20. By participating in a station contest or competition, each participant agrees to receive e-mail communications from the station regarding station events, contests and competitions. Any participant that opts out of these mailings will also remove themselves from the contest or competition. By participating in the contest or competition, where allowed by law, participants agree that the station may disclose personal information obtained from participants in the contest or competition to third parties and use such information for marketing and other purposes.
21. By participating in this competition, participants agree to be bound by the decisions of Station personnel. Participants who violate any rule, gain unfair advantage in participating in the competition, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the competition and all Station decisions concerning such disputes shall be final. If the conduct or outcome of a competition is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Station, the Station reserves the right to terminate the competition, or make such other decisions regarding the administration or outcome as the Station deems appropriate. All decisions will be made by the Station are final. The Station may waive any of these rules in its sole discretion.
ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF A STATION COMPETITION, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF A STATION COMPETITION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
22. By participating in this competition, each participant agrees to waive any and all claims for damages for death, personal injury, loss of property or property damage that she may sustain as a result of her participation in the competition or the use of any prize, and any damages or losses arising from the implementation or carrying out of the competition or any participant’s failure to win the competition or receive the prize, and to release Susquehanna Radio Corp., Radio Station KSAN-FM/107.7 The Bone, and their parent companies, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability arising out of or connected in any way with her participation in the competition, even though that liability may arise out of an intentional act, omission, negligence or carelessness on the part of the persons or entities mentioned above.
23. The Station reserves the right to limit the number of times an individual may enter the "Competition."
24. The Station reserves the right to require participants to be present in order to win their prize.
25. A winners list may be obtained five (5) days after the conclusion of any Station contest or competition by sending a self-addressed stamped envelope to the Station at the address first written above.

All entrants and winners release, discharge and agree to hold the station harmless from any and all claims they may have against the station in connection with the foregoing.
20. By participating in a station contest or competition, each participant agrees to receive e-mail communications from the station regarding station events, contests and competitions. Any participant that opts out of these mailings will also remove themselves from the contest or competition. By participating in the contest or competition, where allowed by law, participants agree that the station may disclose personal information obtained from participants in the contest or competition to third parties and use such information for marketing and other purposes.
21. By participating in this competition, participants agree to be bound by the decisions of Station personnel. Participants who violate any rule, gain unfair advantage in participating in the competition, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the competition and all Station decisions concerning such disputes shall be final. If the conduct or outcome of a competition is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Station, the Station reserves the right to terminate the competition, or make such other decisions regarding the administration or outcome as the Station deems appropriate. All decisions will be made by the Station are final. The Station may waive any of these rules in its sole discretion.
ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF A STATION COMPETITION, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF A STATION COMPETITION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
22. By participating in this competition, each participant agrees to waive any and all claims for damages for death, personal injury, loss of property or property damage that she may sustain as a result of her participation in the competition or the use of any prize, and any damages or losses arising from the implementation or carrying out of the competition or any participant’s failure to win the competition or receive the prize, and to release Susquehanna Radio Corp., Radio Station KSAN-FM/107.7 The Bone, and their parent companies, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability arising out of or connected in any way with her participation in the competition, even though that liability may arise out of an intentional act, omission, negligence or carelessness on the part of the persons or entities mentioned above.
23. The Station reserves the right to limit the number of times an individual may enter the "Competition."
24. The Station reserves the right to require participants to be present in order to win their prize.
25. A winners list may be obtained five (5) days after the conclusion of any Station contest or competition by sending a self-addressed stamped envelope to the Station at the address first written above.
